Minor in Possession (MIP)

Under California law, it is unlawful for persons under the age of 21 to possess alcohol in any public place. College students, high school students, and other minors facing charges for the possession of alcohol or possession of a fake id are often told by law enforcement that they are just receiving a ticket that can be taken care of by paying a fine or completing community service. They are rarely, if ever, informed that their citation carries potential serious criminal and DMV consequences. Minor in Possession (MIP) can be charged as an infraction or as a criminal misdemeanor offense. Possession of a False ID is charged as a misdemeanor criminal offense.

A conviction for an MIP, as either an infraction or a misdemeanor, will automatically result in the loss of your driver’s license for one year. This suspension is automatic and required by law even if you will turn 21 years old within a few months of the incident. The suspension is also required even if the conduct regarding the possession of alcohol did not involve a vehicle.

A conviction for simple misdemeanor charges can have a serious impact on your life. The court will place you on three years of summary probation. Your criminal record is a matter of public record which allows prospective employers, colleges/universities, and any member of the public to view the record. The military does not accept recruits who are currently on probation. As a matter of public record, a misdemeanor conviction must be provided on job applications and financial aid applications if inquired. A criminal conviction can jeopardize scholarships, college applications, and employment opportunities.
